President Trump is set to be sentenced for his bookkeeping case related to the payment to Stormy Daniels on Friday but he his lawyers have asked the Supreme Court to block the sentencing hearing.
“This Court should enter an immediate stay of further proceedings in the New York trial court to prevent grave injustice and harm to the institution of the Presidency and the operations of the federal government,” his lawyers argued.
His lawyers did not argue that the President’s Sixth Amendment rights were violated by this trial, which they were. His argument revolves around the office of the presidency. There is no guarantee that the court takes up this case to prevent the hearing but the judge in the case, Juan Merchan has indicated that he would not sentence the President-elect to prison time.
Meanwhile, the Special Counsel Investigation by Jack Smith has been put on hold for publication by a U.S. District Judge. The President-elect’s lawyers had argued against publication but so had the co-defendants who are still defending themselves. Publishing this before those people had a full right to a defense would be wrong, especially since they are still defending their not-guilty pleas.
Attorney General Merrick Garland opposed the ruling and says that it would like to release at least part of the report that pertains to President Trump. He has just days to do it before the President-elect takes office and he clearly wants to.
